Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") are a binding agreement between you and Sprin World ("we", "us", or "our") governing your access to and use of the Sprin World mobile application, games, and related services (collectively, the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms. You may delete your account at any time from within the app.

4. License to Use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial entertainment. We reserve all rights not expressly granted. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service except as permitted by law.

5. Virtual Currency and Purchases

• The Service may let you purchase virtual currency (such as "gems") and other virtual items using real money through the Apple App Store or Google Play.
• Virtual currency and virtual items are licensed to you, not sold. They have no monetary value, cannot be redeemed for real money or transferred outside the Service, and you have no ownership or property interest in them.
• All purchases are final and non-refundable except where required by applicable law or by the policies of the app store through which you purchased. Refund requests are handled by the applicable app store under its terms.
• Prices and the availability of virtual items may change at any time. We may manage, regulate, modify, or remove virtual currency and items at our discretion, and we have no liability for doing so.
• Unused virtual currency and items are forfeited if your account is terminated or the Service is discontinued, except as required by law.

6. Location-Based Gameplay and Safety

The Service is a location-based game that uses your device's location to enable gameplay. Your safety is your responsibility. When using the Service:

• Be aware of your surroundings at all times. Do not use the Service while driving, cycling, or operating machinery.
• Obey all laws. Do not trespass on private property or enter dangerous, restricted, or prohibited areas to play.
• You assume all risks associated with traveling to real-world locations. To the fullest extent permitted by law, we are not responsible for any injury, death, or property damage arising from your use of the Service or your movement in the real world.

7. Acceptable Use

You agree not to:

• Cheat, exploit bugs, spoof or falsify your location (e.g., GPS spoofing), or use bots, automation, or unauthorized third-party software.
• Harass, threaten, or harm other players, or post unlawful, offensive, or infringing content.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems, or interfere with the Service's operation or security.
• Use the Service for any commercial purpose without our written consent.

We may suspend or terminate your access for any violation of these Terms.

8. Intellectual Property

The Service, including its creatures, artwork, characters, names, logos, software, and content, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited license granted above, these Terms do not transfer any rights to you.

9. Third-Party Services

The Service relies on third-party services (such as the app stores, our hosting and authentication providers, and mapping providers). Your use of those services may be subject to their own terms, and we are not responsible for them.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ACCURATE, OR ERROR-FREE, OR THAT LOCATION DATA WILL BE PRECISE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination will survive.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of [Your governing jurisdiction — e.g., the State of Delaware, USA], without regard to its conflict-of-laws rules. To the extent permitted by law, you and we agree to resolve disputes through binding individual arbitration rather than in court, and you and we waive any right to a jury trial or to participate in a class action. You may opt out of arbitration within 30 days of first accepting these Terms by contacting us. Nothing in this section limits rights that cannot be waived under applicable law.

15. Platform-Specific Terms

These Terms apply to your use of the Service however you obtained it. The following additional terms apply depending on the app store.

Apple App Store

• These Terms are between you and Sprin World only, not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
• Your license to use the Service is limited to a non-transferable license to use it on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide any maintenance or support for the Service. Apple is not responsible for any product warranties, and for any failure of the Service to conform to a warranty, you may notify Apple for a refund of the purchase price (if any).
• Apple is not responsible for addressing any claims relating to the Service, including product-liability, legal/regulatory, or intellectual-property claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play

• Your acquisition and use of the Service through Google Play is also subject to the Google Play Terms of Service.
• Google is not a party to these Terms and is not responsible for the Service. Purchases made through Google Play are processed by Google and are subject to Google Play's payment and refund policies.

16. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms in the app and update the effective date above. Material changes will be communicated where required by law. Your continued use of the Service after changes take effect constitutes acceptance.
